ART. 1: ORDERS

By placing an order, customers agree with our general terms and conditions of sale. 

Return a signed and dated quote with the mention "agreed" or send your personal order stating very clearly your contact information: invoicing address, delivery address, telephone number, email and VAT number for the European Union. The reception of a signed order with the deposit (see Article 4) will ensure its consideration.

ART. 3: PRICES

All prices are in Euros, exclusive VAT and Ex-Works France. They are given without commitment on our part, as an indication. They may be modified at any time by a result of changes in prices of our suppliers or in case of forex changes, depending on the product carriage or postage. Our prices are always listed on our quotes. RF Conception is only liable to the prices indicated on those quotes. The pictures in the presentations are non-contractual. Actual sizes and shapes of the products presented might be slightly different.

ART. 4: TERMS OF PAYMENT

Each invoice is payable at reception. 

1 / For gear and chips: 30% as an order confirmation; the remainder and subsequent charges by bank transfer before shipment (ex-works). All orders are subject to a participation in shipping costs. € 15 ex-VAT of handling fee will be charged for orders below € 150 ex-VAT. 

2 / For services: 30% as order acknowledgment, payment upon the delivery of tags; balance and other charges by bank transfer upon receipt of the invoice. In case of a cancellation of the service, the sums already paid shall not be refunded. 

3 / Other conditions such as a special agreement with the sales department. 

For any payment, our bank details are written at the bottom of our quotations, order acknowledgments, and invoices.

ART. 5: DELIVERY OF YOUR ORDER

Depending on the type of product and your delivery address, we generally work with private transport companies for any shipment in France and abroad. The price depends on what we ship and where we ship it to. At reception, please double check your package and its contents in front of the carrier. Any problems should be reported with reservations on the delivery bill of the carrier. In this case, please notify us of the problem within 48 hours by registered letter.

Delay in delivery: RF Conception cannot be held liable for any delays of delivery if it is due to any reason beyond its control or out of control, such as: accidents, weather, delays in transportation, in supplier deliveries, late returns of equipment rented, strikes, acts of God, customs clearance delays etc....

Delivery times indicated on order acknowledgements are for information only. For orders subject to the transfer of a deposit or to full payment up front, failure to make that payment cancels any agreed upon delivery time. The actual delivery date should not exceed 3 months after the delivery date mentioned on the order acknowledgement. No delay in the delivery or incompleteness of the delivery of an order can justify the cancellation of the order or the payment of a penalty compensation.

ART. 6: GUARANTEE

ART. 6.1: GUARANTEE

Depending on the type of product, warranty is 1-year parts and labor. This is applicable for normal usage of the equipment. This warranty can be extended to 3 years, depending on certain conditions. Shipping costs for the return to RF Conception is at the expense of the client. It is necessary to justify your return to facilitate the process of service. For non-warranty service, RF Conception will send you a quote for repair. If you do not accept it and you want to retrieve the equipment, you must organize the shipment at your expense.

ART. 6.2: DISCLAIMER

This warrantee does not cover damages caused by:

  • Non-compliance with operating or installation instructions, among others electrical supply and exposure to weather conditions

  • Poor maintenance of electrical power sources and of the overall electrical installation

  • Use of the equipment for other ends than the ones it is meant for

  • Negligence from the part of the customer

  • Faults and deterioration caused by normal wear

  • Vandalism, lightning, fire, moisture, weather conditions

  • Malfunctions due to external causes (Examples: radio electrical interferences from other systems, voltage changes)

  • Systems being integrated into or associated with third party equipment not supplied by us, unless explicitly declared in written form

  • Changes made to the equipment, be them legally mandatory

  • Equipment whose serial numbers or identification signs have been taken away

Customers, having read the technical characteristics of the products, are responsible for ensuring they are fit for and able to be used to satisfy his needs. 

ART. 7: RETENTION OF PROPERTY

The goods delivered remain the property of RF Conception until full payment of the invoice.

ART. 8: TAGS

We only guarantee RF Conception products will work properly with tags supplied by RF Conception.

ART. 9: INTELLECTUAL AND INDUSTRIAL PROPERTY

Customer having purchased equipment and/or software have no right to the intellectual and industrial property embedded in them.

RF Conception or the authors and publishers of whom it uses software retain the industrial and intellectual property rights on that software. Depending on each case, RF Conception will ask the customer to sign a specific user licence of the software. If not, the customer will be considered the beneficiary of a personal, non-exclusive and non-transferable licence, for his own internal use.

The customer has the right to use the software and documentation for his own user needs of the equipment sold and shall not:

  • Sublicense, distribute, sell, transfer, rent the software

  • Change or have a third party add changes to the software

  • Make copies or replicate the software

ART. 10: RENTALS

Starting at the delivery of the equipment, and for as long as he keeps the equipment, the party renting it is responsible for all loss, theft, damage or destruction of the equipment, including in cases of fortuitous events, force majeure and acts of God. 

ART. 11: PLACE OF JURISDICTION

In case of any dispute relating to the order, the competent court will be that of the registered office of RF Conception, to which the parties give exclusive competence.
